How do I get started & what does the actual process look like?
- Call Lund Kain & Scott, P.A. and schedule a FREE/NO obligation consultation.
- Meet with one of our experienced Bankruptcy Attorneys who will walk you through your choices. This is the initial consultation. If you can, bring your last two years tax returns, recent pay stubs, and bills to this meeting.
- If you decide at the initial consult to proceed with filing a Chapter 7 Bankruptcy or Chapter 13 Bankruptcy, our staff will have you sign a retainer agreement, collect the deposit, and give you a date to come back for your review and sign appointment. The review and sign appointment is a two hour appointment where you will meet with the staff/attorney for 2 hours to make sure the information on your bankruptcy is correct. If you have not done your credit counseling at the initial consultation, the staff will assist you in completing this course on-line in our office.
- We file your bankruptcy usually a day or two after the review and sign appointment. When this occurs, your are protected from your creditors. (Ask your Bankruptcy Attorney about rare exceptions to this!).
- A month after we file your bankruptcy, you will attend a 341 meeting (i.e. first meeting of creditors) with your attorney.
- Within 30 days of your first scheduled 341 meeting, you will need to complete your debtor education course (2 hours). This can be completed on-line, in person, or telephonically. Our staff will give you information on completing this course.
- If you file a Chapter 7 Bankruptcy, you will receive a discharge in approximately 60 days following the 341 meeting. In a chapter 13, you will receive a discharge when you complete your plan payments or when your timely filed creditors get paid in full which ever occurs first.
